CHARITY AUCTION TERMS AND CONDITIONS

1. By opting to Register and Make a Bid, you acknowledge you have read, understood and agree to be bound by these terms and conditions.
2. The Charity Auction Commences 31 January 2012 and ends on Midnight AEST 26 July 2012.

Placing a Bid
3. By clicking Bid Now, you irrevocably offer to purchase the auction item for the Bid Amount.
4. You cannot retract or modify your bid once it has been submitted
5. The bid amount is in Australian Dollars.
6. By making a bid, you warrant that the information you have provided is accurate and up to date, that you are over 18 years of age, and authorised to enter into and complete this transaction.
7. In order to maintain the integrity of this charity auction, we require that you verify your registration as per Auction System instructions.
8. We undertake to deal with any personal information you provide in accordance with our privacy policy.

Reserve Price
9. The donor of the auction item has requested that we apply a reserve price to this auction. We are under no obligation, but reserve the right to accept a winning bid that does not exceed the reserve price.
10. We are under no obligation to disclose the reserve price.

Successful Bid
11. We will accept the highest verified bid above the reserve price placed before Midnight AEST 26 July 2012 (the 'winning bid'). We will notify you in writing & on our website if your bid has been accepted.
12. If you are notified that your bid has been successful, you must make full payment of the successful bid amount within 30 days.
13. The auction item is at the winning bidder's risk from the date and time notification is sent.
14. Upon receipt of payment in full, we will ship the auction item to your nominated postal address.
15. If your payment is subsequently dishonoured or reversed for any reason, you must immediately make the payment again. We reserve the right to delay processing or delivering the auction item until we receive full payment.
16. You must ensure that you supply us with correct and current delivery instructions.

Donation to Charity
17. We will donate the successful bid amount (less any applicable postage & handling and tax) to RED FROGS AUSTRALIA upon receipt of payment in full.

Disclaimer
18. We warrant that we are authorised to offer the auction item for sale.
19. We do not warrant that the auction service will be available at all times or at any specific times.
20. We do not make any representation as to the quality, condition, or fitness for purpose of the auction item.
21. To the fullest extent allowable at law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded.

Liability and Indemnity
22. We are not responsible for any loss caused by an error or defect in the auction item. You agree to fully release and indemnify, Napier & Dalton Event Management, our officers, employees, agents and contractors from all and any liability or for any claims associated with or arising in connection with this Charity Auction.
23. To the fullest extent allowable at law, Napier & Dalton Event Management'stotal liability to you is limited to the lowest of: (1) the cost of replacing the auction item; (2) the cost of repair of the auction item; or (3) the cost you paid us for the auction item.
24. Under no circumstances is Napier & Dalton Event Management liable for any indirect, special, economic or consequential loss including loss of revenue, profits, goodwill, bargain or opportunities or indirect costs that you or any third party may have incurred in connection with this Charity Auction.
